About Thomas H. Forrester
Tom Forrester is experienced in representing creditors in bankruptcy and other business matters, and has extensive experience in litigating complex commercial disputes. Tom represents debtors, secured and unsecured creditors, court-appointed creditors' committees, buyers and sellers of assets, trustees and lessors, and other individuals and entities that are involved in the administration of business debt. Tom has extensive experience in pursuing claims against creditors in the Bankruptcy Courts and in defending and prosecuting creditors' claims in court. Tom advises clients in bankruptcy cases involving Chapter 11 reorganizations, out-of-court restructurings, receiverships and loan workouts.
Tom advises clients on distressed acquisitions, financing by a bankrupted company and assignments to creditors. He advises clients on investing in distressed assets. Tom is experienced in creditors rights matters and insolvency-related litigation, including drafting collection and recovery orders and defense of preferred and fraudulent transfer actions. He has experience setting up and enforcing receiverships under state and federal receivership statutes.
Tom counsels companies regarding bankruptcy planning, reorganizations, liquidations and other bankruptcy alternatives, as well as plans to become insolvent. Tom works with lenders and borrowers to restructure their credit relationships.
Tom has broad experience representing clients in a broad range of industries and in specialized markets, such as retail, manufacturing, agribusiness, hospitality and service, real estate, airline, healthcare and finance, to name a few. Tom lectures widely on bankruptcy and insolvency issues. Tom serves as a member of the American Bankruptcy Institute and the Tennessee Bar Association Bankruptcy Bar Committee. Tom is a former board member and president of the Mid-South Commercial Law Institute, and served on the Nashville Bar Association Pro Bono Board from 1993 to 1996.
Tom participates in activities such as the Room in the Inn, the Nashville Bar Associations Pro Bono Program, the Justice for Our Neighbors project, as well as running, hiking, backpacking, water sports, tennis and golf.
